Garden heritage case continues

A Launceston businessman’s two-year legal battle about his garden looks set for a three-day hearing mid-year. 

On Friday morning, Hobart Magistrates Court heard there will be testimony from a dozen witnesses in Errol Stewart’s case, where the documentary evidence has grown to more 1000 pages.

In 2021 a neighbour complained to council about Mr Stewart’s garden revamp on Red Chapel Avenue, resulting in charges against the millionaire and his family trust.

Mr Stewart and the trust have maintained not-guilty pleas to a count each of undertaking development contrary to Hobart’s interim planning scheme.

Magistrate Reg Marron has penciled in a July hearing, subject to witness availability.

Council’s seven witnesses will include heritage officers, a planner and a landscape architect.
